【摘要】:Thispracticeisintendedforuseasavoluntarystandardbypartieswhowishtoundertaketheseismicriskassessmentofproperties.Thegoalisforuserstoobjectivelyandreliablycomparethefinancialrisksofearthquakedamagetobuildings,orgroupsofbuildings,onaconsistentbasis.Thispracticeisdesignedtoproviderequirementsfortheevaluationofearthquakedamagerisksothattechnicalreportspreparedfortheevaluationandratingofseismicriskofabuilding(s)willbeadequateforusebyotherentities.Potentialusersincluding,butarenotbelimitedto,thosemakingequityinvestments,lending,andfinancialtransactions,includingsecuritizedmortgagelendingbymortgageoriginators,loanservicers,underwriters,ratingagencies,andpurchasersofbondssecuredbytherealestate.Theuseofthispracticemaypermitausertosatisfy,inpart,theirrequirementsforduediligenceinassessingapropertyrsquo;potentialforlossesassociatedwithearthquakesforrealestatetransactions.1.1Thispracticeestablishesstandard-of-careforevaluationandclassificationofthefinancialrisksfromearthquakedamagetorealestateimprovementsforuseinfinancialtransactions.Assuch,thispracticepermitsausertosatisfy,inpart,theirrealestatetransactiondue-diligencerequirementswithrespecttoassessingandcharacterizingaproperty''spotentiallossesfromearthquakes.Thispracticeisintendedtoaddressonlyphysicaldamagetothepropertyfromsiteandbuildingresponse.1.1.1Hazardsaddressedinthispracticeincludeearthquakegroundshaking,earthquake-causedsiteinstability,includingfaulting,subsidence,settlementlandslidesandsoilliquefaction,earthquake-causedtsunamisandseiches,andearthquake-causedfloodingfromdamordikefailures.1.1.2Earthquake-causedfiresandtoxicmaterialsreleasesarenothazardsconsideredinthispractice.1.1.3Thispracticedoesnotpurporttoprovideforthepreservationoflifesafety,orpreventionofbuildingdamageassociatedwithitsuse,orboth.Thispracticedoesnotaddressrequirementsofanyfederal,state,orlocallawsandregulationsofbuildingconstructionormaintenance.Usersarecautionedthatcurrentfederal,state,andlocallawsandregulationsmaydifferfromthoseineffectatthetimesofconstructionormodificationofthebuilding(s),orboth.ThispracticedoesnotaddressthecontractualandlegalobligationsbetweenpriorandsubsequentUsersofPMLreportsorbetweenproviderswhopreparedthereportandthosewhowouldliketousesuchpriorreports.Thispracticedoesnotaddressthecontractualandlegalobligationsbetweenaproviderandauser,andotherparties,ifany.1.1.4Itistheresponsibilityoftheownerofthebuilding(s)toestablishappropriatelife-safetyanddamagepreventionpracticesanddeterminetheapplicabilityofcurrentregulatorylimitationspriortouse.1.2Considerationsnotincludedinthescope:theimpactsofdamagetobuildingcontents,lossofincome(s),rents,orothereconomicbenefitsofuseoftheproperty,orfromlegaljudgments,firesprinklerwater-induceddamageorfire.1.3Thevaluesstatedininch-poundunitsaretoberegardedasstandard.ThevaluesgiveninparenthesesaremathematicalconversionstoSIunitsthatareprovidedforinformationonlyandarenotconsideredstandard.
